Running head: Assignment 1.1 Conflicting Viewpoints ?Should All states legalize Marriages of the same sex??

Critical Thinking

July 18, 2016 Assignment 1.1 2 Introduction

Procon.org provides some of the controversial and conflicting topics that requires

argument or debates to establish the right courses of action required to address them. One of the

controversial topics suggested for debate by Procon.org is the legalization of same-sex marriages

depending on one?s sexual orientation. Sexual orientation refers to the persistent pattern of sexual

or passionate attraction to females, males or to the two genders equally. Sexual orientation also

relates to how an individual associates with other individuals of identical or opposite sexes and

fascinations. Most studies point out that sexual orientation has been widely understood as either

an exclusive attraction to individuals of opposite sex or exclusive attraction to people of identical

sex. This essay argues whether or not states should legalize marriage between people of identical

sex.

Pros Supporting the Topic

Argument 1: It is discriminatory to deny some people the right to marry

Denying people attracted to others of identical sexes the right to marry violates their

rights and results to the creation of a second class of nationals. In a July 25, 2014 court ruling,

Sarah Zabel termed the ban on gay marriage as unconstitutional and discriminative. She stated

the ban deprived the dignity of couples of identical sex as well as their families, deemed them

unworthy of contribution in social institutions and could easily result to creation of second-class

citizens. By giving them the right to marry, homosexual people will develop a feeling of selfefficacy and sense of belonging in society. Assignment 1.1 3 Argument 2: Couples with identical sexes will have Equal access to the benefits of

marriages as heterosexual couples.

Legalizing the marriage between people of identical sex will enable them access

the rights, protections and benefits such as hospital visitation in the event of illness, family health

insurance, rights if inheritance, bereavement leave and tax reduction through tax reduction.

Therefore, legalizing homosexual marriages will enable states to eliminate irregularities in their

laws and thus allow people attracted to identical sexes enjoy their lives as those in heterosexual

marriages. The law will therefore have protected the rights of all citizens? rights and ensured

equal access to good standards of living regardless of one?s sexual orientation.

Argument 3: Historical definition of marriage as being only between a man and woman

is incorrect.

States should legalize same-sex marriages because form of marriage changes overtime.

Marriage was historically limited to one and one woman and the legal systems prohibited any

other form of marriage. However, polygamy marriage came into existence two centuries ago and

it was legally accepted as a social norm worldwide amid the many the oppositions both religious

and secular. Then came the acceptance interracial marriage in 1950s, which had all along been

banned and declared illegal. Consequently, states should legalize same-sex marriages because the

forms of marriage keep changing as the world modernizes.

Cons Refuting the Topic

Argument 1: Marriage has always been defined as an engagement between a man and a

woman Assignment 1.1 4 States should ban homosexual marriages because the restriction of marriage to people of

dissimilar sexes dates back to past millennia and not just centuries. All countries around the

world have historically recognized marriage as being only between a man and a woman.

Moreover, religious books, which were written centuries ago forbids other forms of marriages

and instead requires marriage to be a bodily and spiritual communion between a man and a

woman

Argument 2: Same-sex marriage defiles nature as Same-sex cannot procreate

States should not legalize same-sex marriages because such marriages interferes with the

primary purpose of marriage of procreating and raising children. Although homosexual couples

may raise children through adoption, legalizing the marriages will increase cases of child

trafficking. The implication of states legalizing same-sex marriages is that marriage is only

meant for sexual pleasures, which is a great violation of nature. Nature defines procreation as the

major purpose of marriage to save and support future generations.

Argument 3: Same sex marriage leads to dysfunctional societies and families as children

need the love of their father and a mother during their upbringing.

Same-sex marriages should banned because the well-being and ethical upbringing of

children requires the intervention of both males and female parents. Research indicates that

children raised single mothers have earlier sexual activities and the girls suffer teenage

pregnancy. Similarly, children raised in the absence of their mothers lack emotional securities

and may have poor mental growth. Hence, children should not be raised by same-sex parents Assignment 1.1 5 because they will have abnormal sexual orientation and experience more challenges with normal

families.

Conclusion

The decision whether or not to legalize same-sex marriage is a controversial issue and

requires scrutiny before taking any legal actions. Legalizing same-sex marriages grants

homosexuals the right to access various benefits enjoyed by their counterpart in heterosexual

marriages. When allowed to marry freely, same-sex partners will develop a feeling of selfefficacy a sense of belonging to the state laws. However, the move will violate religious

teachings and deteriorate the procreation process. Assignment 1.1 6 References
